hey guys,
with all of you getting rid if your yammy bassdrum rosettes does any one want to sell me there old one?
I have a old 9000 24" x 14" in chrome that the previous owner stuck on a Pearl one ...sacrilege!

lol..........that's a first did he drill new holes my guess he did
 
This guy was certainly a plonker,
yes he put two holes in fixed firmly in with an underplate.
Lucky for me he was a plonker though cos
he did sell it to me for £126.!!!
 
I installed mine today. I also added a gasket to the inside of the drum to insure air tightness. I had a hard time deciding which way to face it, but decided to face it the same as the drum badge.

Hi Mike!

I was emailed by a guy looking for a product like yours.

I looked at your plates and they look very professional and you seem to have great following on Drummerworld. This could be a very successful venture for you and this why I am weighing in here as it is a teachable moment.

You may want to seek out a second opinion here, but by selling something which says "Yamaha" and connecting it to drums, you could possibly be infringing on their trademark and opening yourself up to legal action, as this infringes on the Yamaha trademark and dilutes it.

As we all realize, it is possible to find anything on the internet, and if your product catches fire and goes viral, I can guarantee you that the last thing you want to face is losing the money you have earned from this great idea in a lawsuit to a company which could bury you in legal paperwork for the rest of you life.

I can't tell you what to do but I can tell you what I would do:

I would find an attorney who deals in licensing and figure out a subtle way of presenting this idea to Yamaha, if I wanted to keep using their name on my product.

Probably an even better idea would be to come out with a name for my product and run with it as it would circumvent all of the need for dealing with all of the drum companies out there as going with just Yamaha would limit my possibilites as I could make these to replace the holder on Tama, Pearl etc.

I would also check into a design patent (which I rarely recommend) as I want to make certain that drum company X doesn't see it and then start making their own with "Yamaha" on it. I look at it this way: it's my idea and it was my sweat which made it into such viable product that people all around the globe want to buy one from me. If drum company "X" wants their name on it, then drum company X needs to license it from me so that they can get their brand name (advertised) on it.

Design patents aren't as expensive as a utility patent sign your patenting only the design of your product.

Make no mistake, I think you have a winner here as evidenced by the pages of responses you have received. I have no vested interest one way or another in your success; just make sure your hard work doesn't end up benefiting someone else (in this case, Yamaha who really doesn't need the money as bad as you) as a reult of your naivetey. I would like to see you beneift form such a great idea.

This was just courtesy note but it can turn into an "up yours" argument real quick if you want it to. I figured there are already too many of those on this forum.

Back in the day (meaning about 25 years ago), there was no internet and policing such things was very difficult as anyone who had intellectual property had to "luck" into catching the perpetrator/infringer. Case in point; I had many friends who made up Texas state flags but with the "OU" block lettering in place of the star. Seemed fitting since OU owned the Longhorns every year in the mid-eighties.

Now, there is heavy policiing of such materials (even in the drum market) as, with a bad economy, companies are looking for more revenue and the protection of their intellectual property is an easy way to do it. There are entities which sole purpose for exsisting is to police such practices. You can find one of them running up and I-35 from Oklahoma City to Austin every second week in October. The contraband materials are confiscated and the perpetrators are out their investment, open for a lawsuit and some are taken to jail.

Furthermore, give the duality of the nature of the internet and websites like this, it is all too easy to find infringers and take legal action. Another case in point, I found out that a former band was still using my photographed likeness. They were very easy for my attorney to find as they posted their performance schedule all over the internet and he let them know that they should "refrain from using my photographed likeness without monetary compensation in order to promote thier band for monetary gain", showing up right at one of their gigs! I heard the band leader had a bad night singing that night; he must have been scared sh!tless!

The bottom line on all of this is that even if you know and are in contact with people in "Cali, Japan and Europe already", ALWAYS get their permission to use their name in writting because, after all, money changes everything especially in the music business! The written permission pretty much heads off most litigation as it domcuments "right to use". If something bearing their name and IP catches fire and explodes on the market, you can bet they will want their share of the loot and,if the company changes leadership, you can find yourself in a negative relationship real quick. this hapens to signed bands all of the time, leaving them holding the bag, unable to perform songs they wrote because the record label now owns them and won't release the album because the new president/CEO has "decided to go a different direction".

Like I said at the top of this post, I merely making a courtesy post and I would like to see less of the "I think I am a very important person and I am smarter than anyone else" or "You don't understand who I think I am" post typical of such arguments. This wasn't made to start an argument; it was merely informative because SoCalMike has a great idea; he just needs to protect his idea so the HE beneifits from it, even if he has to pay license to Yamaha/Pearl, et al.

what a great idea and what a great look for those yamaha drums. Sounds so stupid, but the only thing i never liked about the yamaha's was that they didn't come virgin. Not really for the sound — yamaha's sound incredible — just for the look. I cant believe how it improves the look of these drums.

i hope you find another printer. You had a good thing going.

I don't see that happing after my Buddy lost his shop I do have a few of the first batch that I made but after that thats it......
